These Terms of Service ("Terms") govern your access to and use of Mobric's commercial truck valuation platform ("Service," "Platform," or "Mobric"). By accessing or using the Service, you agree to be bound by these Terms.
This service is intended for commercial use by businesses in the automotive industry. By using Mobric, you represent that you are authorized to bind your organization to these terms.

One Account Per User/Business: Each account is for individual or single-business use only. Multi-user licenses are available upon request.
Mobric reserves the right to suspend or terminate accounts that violate eligibility requirements. We are not liable for unauthorized access if you shared credentials or failed to maintain account security.
Subject to your compliance with these Terms, Mobric grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for legitimate business purposes related to commercial truck valuation.

Your Data: You retain ownership of data you input into the Platform (e.g., VIN numbers, company information). By using the Service, you grant Mobric a license to process your data solely to provide valuations and improve the Service.
Critical Restriction
VIN data and vehicle information may only be used for legitimate business purposes within the Mobric platform. Resale, redistribution, or unauthorized commercial use of VIN data is strictly prohibited.

Mobric offers subscription-based pricing with monthly or annual billing cycles. Current pricing and plan details are available on our website.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel anytime through your account settings or by contacting support@mobric.org.
Mobric may change subscription pricing with 30 days' advance notice. Price changes will apply at your next renewal date. Continuing your subscription after notification constitutes acceptance of the new pricing.
All subscription fees are non-refundable except as required by law. If you cancel mid-cycle, you retain access until the end of your current billing period.
Failure to pay on time may result in:
Mobric strives to provide 99.5% uptime per month for core valuation features. Uptime is measured excluding:
Planned maintenance typically occurs Sundays 2:00am - 4:00am EST (maximum 2 hours monthly). We provide 72-hour advance notice via email and status page.

MOBRIC IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
Valuations provided by Mobric are estimates based on available market data and should not be considered guarantees of value. Customers are responsible for verifying all data before making business decisions.

Verification Required: Always verify truck values through additional sources before making purchasing, selling, or financing decisions.
Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBRIC'S TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Both parties agree to keep confidential any proprietary information disclosed during the term of this agreement. Confidential information includes business strategies, customer data, technical specifications, and pricing information.

Mobric processes personal data in accordance with our Privacy Policy. By using the Service, you consent to such processing.

Your subscription continues until you cancel or we terminate your account. Subscriptions auto-renew unless cancelled before the renewal date.

You are responsible for the accuracy of all data you enter into the Platform. You grant Mobric a license to store and process your content to provide the Service. Mobric is not liable for any claims arising from your content.
Governing Law: These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions.
Jurisdiction: Any disputes shall be resolved in the state or federal courts located in Delaware. Both parties consent to personal jurisdiction in Delaware.
Attorneys' Fees: The prevailing party in any dispute may recover reasonable attorneys' fees and costs.
Mobric may modify these Terms with 30 days' notice via email or in-app notification. Material changes require your explicit acceptance. Continued use after the notice period constitutes acceptance of the new Terms. If you object to changes, you may cancel within the notice period.
Support Availability: Business hours (Monday-Friday, 9:00am-5:00pm EST)

Response Time: We aim to respond to non-critical issues within 24 hours during business hours.
Mobric may suspend or terminate your access for: Terms violations, non-payment, security threats, or legal requests. Suspension may be immediate or with notice depending on severity. Upon termination, all access is revoked and data may be deleted within 90 days.
Mobric integrates with third-party services including Stripe (payments), Supabase (database), Resend (email), Anthropic (AI processing), and Vercel (hosting). You are responsible for complying with third-party terms. Mobric is not liable for third-party service failures or changes to third-party APIs.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mobric.
If any provision is found invalid, the remaining provisions remain in effect.
Failure to enforce any provision does not waive our right to enforce it later.
You may not assign these Terms. Mobric may assign these Terms with notice in connection with a merger, acquisition, or sale of assets.
Neither party is liable for delays or failures due to events beyond reasonable control (natural disasters, war, pandemic, government actions, etc.).
These Terms do not create a partnership, joint venture, employment, or agency relationship.
